The men have been indicted by a grand jury on charges which include aggravated sexual exploitation of a minor, and a charge of aggravated rape of a child. Isiah Hayes was 17 at the time of the alleged attack in Memphis, Tennessee, and a friend, Dairius Ice, 22, is alleged to have filmed the attack.
The two men were arrested, after the mother of the 9-month-old baby who found a cellphone video of her child being raped, recognized the assailant. According to Tennessee Police, the alleged rape was reported to police in October 2016, after the girl’s mother found the video on Oct. 14.
The Shelby County District Attorney’s Office announced two years later on Tuesday, that both men were indicted by a jury because of the accusations. Hayes’ older brother, who asked not to be named, told local TV station WREG the family found the arrests “heartbreaking and scary”.
“Us as a family, we apologise. I know that the child may not remember but it’s something a mother is going to have to hold on to forever. Like, knowing that your child was exposed to something like that. You trusted your child with someone, and you have to deal with seeing this on your own”.
He wants his brother to get help, and says the video surfacing was down to a family feud. A spokesman for the Commission on Missing and Exploited Children, Len Edwards, told the TV station that crimes such as this were often motivated by money rather than sex.
“There are 1.5 million images of child pornography in this country – and last year only 10,000 children were actually identified,” he said.
